PRIVACY POLICY

OUR COMMITMENT TO PRIVACY

At Enlightened Benefits Consulting Ltd. ("EBC"), we are committed to providing our clients with exceptional service. As part of this commitment, we recognize the importance of protecting personal information. This Privacy Policy outlines how we collect, use, and disclose personal information in compliance with Alberta's Personal Information Protection Act (PIPA) and, where applicable, Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). We will inform our clients of the purposes for which we collect, use, and disclose personal information, obtain their consent where required, and handle their information in a manner a reasonable person would consider appropriate under the circumstances. Our privacy commitment includes ensuring the accuracy, confidentiality, and security of personal information and allowing clients to request access to and correction of their information.

 

SCOPE OF THIS POLICY

This Privacy Policy applies to Enlightened Benefits Consulting Ltd. and to any service providers collecting, using, or disclosing personal information on our behalf.

 

DEFINITIONS

  • Personal Information means information about an identifiable individual including name, age, home address, telephone number, driver’s licence, secondary identification numbers, marital status, credit history, medical information, education, and employment history. It does not include contact information.

  • Contact Information means information that enables an individual to be contacted at a place of business and includes name, position title, business telephone number, business address, business email, or business fax number.

  • Privacy Officer means the individual designated to ensure EBC’s compliance with this policy and applicable privacy legislation.

 

1. COLLECTING PERSONAL INFORMATION

1.1 We will communicate the purposes for collecting personal information before or at the time of collection unless the purpose is obvious and the client voluntarily provides the information.

1.2 We only collect personal information necessary to fulfill the following purposes:

  • To verify identity (e.g., name, address, birth date);

  • To verify creditworthiness;

  • To identify client preferences;

  • To understand the financial and insurance needs of our clients;

  • To open and manage accounts;

  • To deliver requested products and services;

  • To enrol clients in programs;

  • To ensure high-quality service;

  • To meet legal and regulatory requirements;

  • To assess underwriting requirements;

  • To collect and process payments.

 

2. CONSENT

2.1 We will obtain client consent to collect, use, or disclose personal information, except where authorized by law.

2.2 Consent may be given orally, in writing, electronically, through an authorized representative, or implied where the purpose is reasonably obvious.

2.3 Consent may also be implied if the client is given notice and a reasonable opportunity to opt out of use for purposes such as marketing, and does not do so.

2.4 Clients may withhold or withdraw consent, subject to legal or contractual restrictions. This may impact our ability to provide certain services, which will be explained if applicable.

2.5 We may collect, use, or disclose personal information without consent in limited circumstances:

  • When permitted or required by law;

  • In emergencies threatening life, health, or security;

  • When the information is publicly available;

  • For legal advice;

  • To collect a debt;

  • To prevent fraud;

  • To investigate breaches of law or agreement.

3. USING AND DISCLOSING PERSONAL INFORMATION

3.1 We use and disclose personal information only to fulfill identified purposes or purposes reasonably related to those.

3.2 Reasonable secondary uses may include:

  • Conducting client satisfaction surveys;

  • Providing information about related products or services.

3.3 We do not sell client lists or personal information to third parties.

3.4 We will not use or disclose personal information for additional purposes without obtaining consent.

4. RETAINING PERSONAL INFORMATION

4.1 If we use personal information to make a decision that directly affects a client, we retain it for at least one year.

4.2 We retain personal information only as long as necessary to fulfill identified purposes or comply with legal obligations.

5. ACCURACY OF PERSONAL INFORMATION

5.1 We make reasonable efforts to ensure personal information is accurate and complete when used to make decisions or disclosed to third parties.

5.2 Clients may request corrections to their personal information in writing, identifying the specific information and desired correction.

5.3 If a correction is made, we will notify any third party to whom the incorrect information was disclosed in the past year. If no correction is made, we will document the request.

 

6. SECURING PERSONAL INFORMATION

6.1 We protect personal information from unauthorized access, use, disclosure, or destruction.

6.2 Security measures include:

  • Secured physical office space;

  • Use of user IDs, passwords, encryption, and firewalls;

  • Restricted employee access based on need-to-know;

  • Contractual requirements for service providers to maintain comparable security standards.

6.3 Personal information will be securely destroyed (e.g., shredding, electronic deletion) when no longer required.

6.4 We review and update security practices regularly to maintain protection.

 

7. CLIENT ACCESS TO PERSONAL INFORMATION

7.1 Clients have the right to access their personal information, subject to limited exceptions under section 24 of Alberta’s PIPA (e.g., solicitor-client privilege, health and safety risks, proprietary business information).

7.2 Access requests must be made in writing and provide enough detail to identify the information.

7.3 Upon request, we will inform clients how their information has been used and to whom it has been disclosed, if applicable.

7.4 We will respond within 30 business days or provide notice if an extension is required.

7.5 A minimal fee may be charged; if applicable, we will notify the client in advance.

7.6 If a request is refused, we will provide written reasons and available recourse.

 

8. QUESTIONS OR COMPLAINTS

8.1 Our designated Privacy Officer is responsible for ensuring compliance with this policy.

8.2 Clients with questions or concerns about EBC's handling of personal information should contact our Privacy Officer in writing. If the issue is not resolved, clients may contact the Office of the Information and Privacy Commissioner of Alberta.
